Rules for using the CamperTrader.pl marketplace - publishing listings, paid services, consumer rights, complaints.
These Terms of Service set out the rules for using the CamperTrader.pl marketplace, available at https://www.campertrader.pl (hereinafter: the "Service").
The owner and operator of the Service is Atlas Road Konrad Kopikowski, conducting business activity with its registered office at Aleje Jerozolimskie 109/70, 02-011 Warsaw, Poland, Tax ID (NIP): 9521911803, e-mail: [email protected] (hereinafter: the "Operator").
These Terms constitute terms for the provision of services by electronic means.
The Terms are made available in the Service free of charge in a manner that allows for their acquisition, reproduction and storage.
User – any person using the Service.
Consumer – a User who is a natural person performing an act unrelated directly to their business or professional activity.
Entrepreneur – a User using the Service in connection with their business or professional activity.
Advertiser – a User publishing a listing in the Service.
Service – a service provided by electronic means consisting of enabling the publication and presentation of listings.
Private Account – the account of a User who is a natural person not conducting business activity, using the Service for private purposes.
Business Account – the account of a User who is an Entrepreneur, using the Service in connection with their business or professional activity.
The Service operates in a mixed model (B2C/B2B).
The Operator is solely a technology intermediary and is not a party to agreements concluded between Users.
The Operator is not liable for the performance or non-performance of obligations arising from agreements concluded between Users.
Publishing listings in the Service requires the creation of a User account.
The listing publication period is 30 calendar days.
The User is obliged to provide true, current and complete data.
The User bears full responsibility for actions taken using their account.
During registration, the User selects the type of account by ticking the appropriate checkbox (Private Account or Business Account) and is responsible for correctly determining their status.
Publishing listings in the Service is, as a rule, free of charge.
The free-listing limit for each User is a maximum of 5 listings added per calendar month. The provisions of this paragraph do not apply to Dealers using the Dealer Panel.
The Operator may offer paid additional services, in particular listing promotions or promotional packages (hereinafter: "Paid Services").
Paid Services are optional and do not affect the ability to publish a listing in its basic version.
Before using a Paid Service, the Advertiser is each time informed of its price and scope.
The Advertiser declares that they hold the rights to publish the content, photos and materials included in the Listing and that their publication in the Service does not infringe the rights of third parties.
It is prohibited to publish listings or other content that:
The Operator is entitled to remove or modify listings that violate the Terms.
The Operator may also refuse to publish or remove a listing where its content is contrary to the nature of the Service or the principles of fair trade.
The Operator maintains a procedure for reporting content that violates the Terms (notice & action). Reports may be submitted via the contact form or by electronic means.
The Operator processes reports without undue delay and takes appropriate action, in particular the removal or limitation of content visibility.
In the event of flagrant or repeated violations of the Terms, the Operator may, while observing the principle of proportionality, temporarily suspend or permanently block a User's account (recidivism mechanism).
Where there is a justified suspicion of a criminal offence, the Operator is entitled to provide the competent authorities with information and data within the scope provided for by law.
The Operator may store and archive the content of listings after their publication period has ended for the purpose of ensuring the continuity of the Service, archiving or for evidentiary purposes.
The Operator may use statistical data regarding the use of the Service for the purposes of traffic analysis, feature development and improvement of service quality.
Paid Services consist of increasing the visibility of listings in the Service for a specified period.
Paid Services are optional and do not affect the ability to publish a listing in its basic version.
Paid Services are provided against payment in accordance with the current price list available in the Service.
Payments are made in advance, before the Paid Service is rendered.
Payments are processed, at the User's choice, through external payment operators: Przelewy24 (PayPro SA) and PayTel S.A.
For payments made via Przelewy24, the payment operator is PayPro SA with its registered office in Poznań (60-198), ul. Pastelowa 8, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto i Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS No. 0000347935, Tax ID (NIP) 7792369887, REGON 301345068.
For card payments within the Przelewy24 system, the card payment operator is PayPro SA, ul. Pastelowa 8, 60-198 Poznań.
For payments made via PayTel, the payment operator is PayTel S.A. with its registered office in Warsaw (02-092), ul. Żwirki i Wigury 14, entered in the Register of Entrepreneurs of the National Court Register under No. 0000332228, Tax ID (NIP) 5272606618, REGON 141802150, being a domestic payment institution supervised by the Polish Financial Supervision Authority, entered in the register of payment services under No. IP32/2015.
Making a payment through the selected operator also constitutes acceptance of the terms and conditions of service provision by that operator.
The contract for the provision of a Paid Service is concluded at the moment of successful payment.
Prices listed in the Service are final prices (the Operator benefits from the VAT exemption under Article 113(1) of the Polish VAT Act).
Entrepreneurs receive an invoice upon request or in accordance with applicable law.
Natural persons not conducting business activity receive a payment confirmation.
A Consumer has the right to withdraw from a distance contract within 14 days from the day of its conclusion, without stating any reason, subject to the provisions below.
In the case of Paid Services consisting of listing promotion, which are activated immediately after payment at the express request of the Consumer, the Consumer consents to the commencement of service provision before the lapse of the withdrawal period.
The Consumer acknowledges that upon full performance of the Paid Service they lose the right of withdrawal.
If the Consumer exercises the right of withdrawal before full performance of the Paid Service, settlement shall take place in accordance with applicable law.
In the event of non-performance of a Paid Service for reasons attributable to the Operator, the User is entitled to a refund or an extension of the service.
In the case of a properly performed service, no refund is due, subject to applicable law.
Refunds are made to the account from which payment was made, within 14 days of the complaint being upheld.

Complaints are processed within 14 days of receipt.
The User will be informed of the outcome of the complaint by e-mail.
The Operator is not liable for the content of listings or for agreements concluded between Users.
The Operator does not verify the technical data of vehicles, parameters, mileage or equipment indicated in the Listings and is not liable for their conformity with the actual state.
The Operator's liability towards Consumers is limited only within the limits permitted by mandatory provisions of law.
In relations with Entrepreneurs, the Operator's liability, irrespective of the legal basis of the claim, is limited solely to actual damage (damnum emergens) arising from the Operator's wilful misconduct and to the amount actually paid by the User for the Service to which the claim relates. The Operator is not liable for lost profits, indirect damages, consequential damages or lost revenue.
The Operator does not guarantee the achievement of specific results in connection with the publication of a listing, in particular the sale of the item, the number of views or the number of inquiries from potential buyers.
The Operator may change the way listings are presented, their order and the algorithm for displaying listings in the Service, including the criteria for sorting search results, without any right of claim on the part of Users.
The controller of personal data is the Operator.
Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
Detailed rules for data processing are set out in the Privacy Policy available in the Service.
The Operator may amend the Terms only for important legal or organisational reasons.
Users will be notified of changes at least 14 days in advance.
The Operator reserves the right to change the functionality of the Service, introduce new services, modify existing functions or withdraw them within the scope resulting from the technological development of the Service, without any right of claim on the part of Users.
These Terms are governed by Polish law.
Disputes with Consumers shall be resolved by the courts competent under general provisions.
Disputes with Entrepreneurs shall be resolved by the court competent for the Operator's registered office.
These Terms enter into force on 1 March 2026.
